This week has seen a flurry of activity surrounding the Chelsea’s licensing woes. Here’s a quick recap to get you up to date:
- On Tuesday morning, April 28th, Chelsea’s lost the Motion to Dissolve the TRO (temporary restraining order - an injunction) that was in place and allowing them to sell alcohol on a temporary basis until the full hearing before Judge Trudy White on Monday, May 4th
- Judge White held that the pleadings on behalf of the defendant, Remmeter, LLC, were insufficient to sustain the TRO, but maintained the court date and full hearing set for Monday, May 4th (another bite at the apple)
- Brandon Brown filed another TRO on Tuesday with more substantial evidentiary support - a more complete and comprehensive pleading
- We have not yet heard back from Judge White on this most recent filing (perhaps Chelsea’s will get another TRO enabling them to sustain alcohol sales between now and Monday)
- If the TRO filed on Tuesday fails, Chelsea’s will still be back in court on Monday for a full hearing on whether the Judge will grant a longer TRO or injunction of perhaps up to 6 months while allowing Remmeter, LLC to pursue rezoning, a change in governing law or perhaps make adjustments to the business plan that will satisfy the ATC (office of Alcohol and Tobacco Control)
