PETITION: Support SB 136

We, the undersigned, urge you to support SB 136 by Senator Lydia Jackson.

Across Louisiana, there are existing restaurants operating under a business model that is now under assault by the Office of Alcohol and Tobacco Control. By supporting SB136 you'll help to protect legitimate businesses that operate primarily as a restaurant, but that also provide live entertainment, require cover charges, or offer drinks at a reduced cost.

Gaps in the present law on Class R alcohol licenses leave room for interpretation by ATC officials, leading to uneven and inconsistent enforcement of this provision. But with the minor adjustments accomplished by SB136, the law would be updated, inconsistencies would be cured, and these otherwise lawful and uncontroversial establishments would come into compliance.

Please support this effort to clarify the law so that restaurants across the state can serve their communities without the extra burden of arbitrary regulatory enforcement.

    Chelsea's is one of our favorite restaurants and is a great gathering place for our neighborhood. It is very family-friendly at lunch and dinner time, but the best place in town to see live bands later at night. Chelsea's and the other businesses in the Perkin's overpass area are one of the main reasons we bought a house in the Hillsdale neighborhood. Considering the national trend towards Traditional Neighborhood Developments (TNDs) like Perkin's Rowe and Rouzan which are only *copies* of authentic neighborhoods like ours, I would think people would understand what a treasure great establishments like Chelsea's are to classic older neighborhoods.

    I have dabbled in the restaurant business enough to know that the secret of success for small, independent establishments is to spread overhead expenses as widely and efficiently as possible. Thus, though I don’t know Chelsea’s owner personally, I can see the logic of his business model. The more “down time” the building has, the higher the cost that must be passed on to customers. It is quite possible that Chelsea’s uses revenues from its cover charges and “after-dinner” drink sales to subsidize diners, which is fine with me. Chelsea’s is one of my favorite restaurants because the food is delicious and the prices are reasonable. Family members and out-of-town guests that accompany me to the establishment enthusiastically agree.

    I lived in Baton Rouge for 6 years, and worked at Chelsea's while getting a degree at LSU. I now live in Knoxville, TN. They have a law similar to the one you are proposing. Places that would be like Chelsea's Cafe are forced to split their atmospheres and personalities and choose. Chelsea’s Café has always been a great thing for me while living in Baton Rouge, and has stayed close to my heart after living in many different places. I believe what it has is special, and keeps Baton Rouge youth on a progressive path for the town. In addition, there are no others of its kind in town, so if the nearby communities lose Chelsea’s Café, they will strongly lack in places to congregate and share ideas.

    Chelsea's serves some of the best food in Baton Rouge, and is one of only two or three places in town where you can go to hear good live music on a regular basis.     The main reason I live in this neighborhood is because within walking and biking distance of my home are grocery stores, locally owned restaurant and bars, venues to see good live music, a park, an art gallery, a golf course, a university, churches, a women's spiritual center, coffee shops, a used book store and other like minded people who want the same. Give us safe walking and biking paths and we'd be a model community. The national trend is to create communities like this one. Why is our local government trying to destroy an integral part of our neighborhood (Chelsea's) based on a loose interpretation of a poorly written law? If there's a problem with restaurants playing and charging for live music, let's get to the bottom of the issue. Are they keeping people up late at night? Are yards getting parked in? Are some people in the area upset? If so, there's room for working things out. There's no reason to shut down a local business that employs nearly fifty people, unites a community and encourages tourism. There are many local businesses that can benefit from SB 136. Support local business!

    People around here love to rail against wasteful government spending. The ATC and its campaign against Chelseas is one such example. It took 10 salaried agents to raid Chelseas and harrass its customers and employees? Give me a break. I wonder how much this whole ordeal cost. The ATC could have simply required Chelseas to get a new type of license and afforded them enough time to actually do it. Targetting small businesses and hassling the owners of beloved Baton Rouge institutions should not be business of the ATC.     I have been a part of the Chelsea's atmosphere for well over a decade. I have played music there and listened to music there. Today, for me it is a community hang out of friends and family that I can enjoy along with my wife, 14 year old, two year old, and 8 month old while my 61 year old father is right there with me. It is one of few places that crosses so many boundaries. There actually should be even more places like this as well as more business owners/employers like Dave.     Although I am considered to be of senior status, I am a regular visitor of Chelsea’s having enjoyed the food and the music on several occasions with my adult children. This issue with Chelsea's Cafe is ridiculous, embarrassing to our city, and a classic example of typical old time Baton Rouge politics. That particular building has housed bars by different former owners for over four decades. In addition to Chelsea’s having occupied this property for many years, this property is surrounded by several other restaurants and bars that also have been in business long-term. The Zee Zee Gardens area and the independently owned businessses there is one of the jewels of our city. We desperately need our young adults and emerging entrepreneurs to stay in Baton Rouge, now more than ever.
